The Economic Affairs Interim Committee Meeting

The Economic Affairs Interim Committee met on August 29, 2024, to discuss the topic of marijuana.

Metrc – COA Functionality

Testing Facilities now have the option to upload a Certificate of Analysis (COA) that is associated with all recorded test results of a specific test sample package.

The department encourages testing labs to utilize this functionality, but is not yet required.

Department Rules Update

MAR Notice No. 42.1071, pertaining to revised sampling protocols and quality assurance testing requirements, was adopted on August 24, 2024.

Please note the following upcoming implementation dates that do not fall on the above adoption date:

• 9/24/2024 – ARM 42.39.614(10)(f)
• 2/24/2025 – Appendix version 1.0, Table 4.0b
• 2/24/2025 – ARM 42.39.601(22)
• 2/24/2025 – ARM 42.39.614(3)

Anecdotal Statements Are Not Allowed on Electronic Advertising

Reminder re: electronic advertising; 16-12-211(3)(a)(v), MCA states:

“A licensee may engage in electronic advertising such as maintaining a website and advertising on web applications, provided that no electronic advertisement produced by the licensee contains a statement or illustration that makes any health, therapeutic, or medicinal claims about marijuana or marijuana products.”

This includes anecdotal statements. Licensee may not use these statements in electronic advertising

Guidance on Submitting Documents

Please submit clear documents for applications:
• Do not submit photos of documents that can be sent as PDFs. Preferably, no screenshots of documents.
• Provide a detailed description of the document.
• Deficiency responses must be submitted using the “Cannabis Statement of Deficiencies Response” application.
