How to Report Unclaimed Property


Introduction

House Bill 136, signed into law by Gov. Greg Gianforte on May 18, 2023, revises the Montana Unclaimed Property Act and requires holders of Virtual Currency to liquidate and remit the Virtual Currency in United States currency to the Administrator within 30 days of filing the report. The bill also changes the dormancy period of Securities from 5 years to 3 years. This is effective after June 30, 2023 and will have no impact on the Fall 2023 reporting cycle.

Unclaimed Property is any financial asset that is held, issued, or owed, for which an owner has not indicated an interest in the property during a certain period of time. These assets may include, checks, savings or checking accounts, wages, credit balances, deposits, insurance proceeds, securities, virtual currency etc.

A Holder is a person obligated to hold, deliver, or pay the owners property. Holders may include, business and business associations, financial organizations, insurance companies, etc.

Instructions

An unclaimed property holder must report unclaimed property for owners with a last known address in Montana after the dormancy period.

The Dormancy Periods and Property Type Codes displays how long the property needs to be dormant prior to reporting to the state.

If you are a corporation or non-corporate business operating in Montana, you must also report amounts owed to:

  • Unknown or unidentified owners,
  • Owners with foreign addresses, and
  • Owners with unknown address.

Holders must send a written notice to property owners 60—120 days before reporting, unless noted as an exception in 70-9-808, MCA.

Negative or zero-dollar reports are not required by Montana.

We do not accept and cannot process holder reports on magnetic media such as compact discs, diskettes, tapes and USB devices.

Unclaimed Securities

Do not report worthless, nontransferable, or restricted securities.

When reporting securities, please remember that your report is not complete until you provide evidence of the property being transferred into the ownership of the State of Montana. The required evidence depends on the type of security and how it will be delivered to our custodian on behalf of the state. Please review the Securities section of our Unclaimed Property Holder Guide for these specific requirements.

Make sure to submit to our custodian and attach DORUCPSecurities@mt.gov an Intent to Deliver before delivering any unclaimed securities.
